Can You Vape in Public in South Africa? Airports, Restaurants & Malls Explained

Whether you can vape in a specific place in South Africa depends on three things: the current law, the proposed new law (which is not yet in force), and the rules of the specific venue. Here’s a clear breakdown.

Current law (still in effect)

South Africa’s Tobacco Products Control Act of 1993 governs where smoking — and to some extent vaping — is permitted. Under current law, vaping is prohibited in the same places as smoking: enclosed public spaces, workplaces, public transport, and healthcare facilities. This includes restaurants, shopping malls, offices, and public buildings.

In practice, enforcement varies significantly by venue. Some places actively enforce no-vaping rules; others don’t. But the legal framework treats vaping in enclosed public spaces the same as smoking a cigarette.

The proposed Tobacco Products and Electronic Delivery Systems Control Bill

A new Tobacco Bill has been working through Parliament and would significantly tighten restrictions if passed. Under the proposed bill, vaping would be explicitly prohibited in all enclosed public spaces, workplaces, public transport, healthcare and educational facilities, and within a defined perimeter of entrances to these spaces. It would also prohibit vaping in any vehicle when a minor is present.

Airports

South African airports generally do not permit vaping inside terminal buildings. O.R. Tambo, Cape Town International, and King Shaka all have designated smoking areas outside the terminal — these are typically the only sanctioned areas for vaping. Vaping at the gate, in the lounge, or in queues is not permitted. On aircraft, vaping (including e-cigarettes) is prohibited by all South African carriers under civil aviation rules, regardless of the airline’s policy on smoking.

Restaurants and bars

Indoor vaping is generally not permitted at restaurants. Some bars and nightclubs may be more permissive, particularly if they have good ventilation or outdoor areas — but this is venue-specific, not a legal exception. Always ask staff before vaping indoors at a venue.

Shopping malls

Major South African shopping malls prohibit smoking and vaping inside the mall. Designated smoking areas outside (often near parking entrances) are the standard provision. Vaping while walking through a mall, even briefly, is generally against mall policy and the law.

Outdoors and private property

Vaping outdoors in public spaces (streets, parks, open areas) is generally not restricted under current law. On private property, the property owner’s rules apply. If you’re vaping at a private home, garden, or outdoor venue, it’s at the discretion of the host.
